DMCA NOTICE & TAKEDOWN POLICY

OVERVIEW

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials hosted on the Land & Sea International Realty website (the “Site”) infringe your copyright, you (or your authorized agent) may send us a written DMCA takedown notice (“Notice”) requesting that the material be removed or access to it be disabled.

FILING A DMCA TAKEDOWN NOTICE

If you believe that material on or accessible from the Site infringes your copyright or the copyright of a person you are authorized to act on behalf of, please send a written Notice to our Designated Copyright Agent identified above. Under Section 512(c)(3) of the DMCA, your written Notice must include all of the following:

  1.      A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
  2.      Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3.      Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material on the Site.
  4.      Sufficient contact information for the copyright owner or authorized person, including full name, mailing address, telephone number, and, if available, email address.
  5.      A statement that the copyright owner or authorized person has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6.      A statement that the information in the Notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner of the material that is allegedly infringed.

Please note that your written Notice may not be fully effective and may not comply with Section 512(c)(3) of the DMCA unless it includes all of the information detailed above.

COUNTER-NOTIFICATION PROCEDURE

If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent pursuant to Section 512(g)(3) of the DMCA. Your counter-notification must be in writing and must include all of the following:

  1.      Your physical or electronic signature.
  2.      Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3.      A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4.      Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the Southern District of Florida), and that you will accept service of process from the person who provided the original takedown Notice or that person’s agent.

Upon receipt of a valid counter-notification, Land & Sea International Realty will promptly forward a copy to the party who filed the original Notice. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within ten (10) business days of receiving the counter-notification, Land & Sea International Realty may, in its sole discretion, restore the removed material or cease disabling access to it.

REPEAT INFRINGER POLICY

In accordance with Section 512(i) of the DMCA, Land & Sea International Realty has adopted a policy of terminating, in appropriate circumstances and at Land & Sea International Realty’s sole discretion, the accounts or access of users who are deemed to be repeat infringers. Land & Sea International Realty may also, at its sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

WARNING REGARDING MISREPRESENTATION

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. Before filing a Notice or counter-notification, you may wish to consult with an attorney to understand your rights and obligations under the DMCA.

GOOD FAITH COMMUNICATIONS

Land & Sea International Realty respects the intellectual property of others and expects its users to do the same. In the event of a dispute, Land & Sea International Realty encourages the parties involved to resolve the matter directly before resorting to formal legal proceedings. However, Land & Sea International Realty is under no obligation to mediate or otherwise intervene in any such dispute.

RESERVATION OF RIGHTS

To be clear and notwithstanding any other term of this Policy, Land & Sea International Realty, in its sole discretion, reserves the right to remove or disable access to any material posted on its Site for any length of time (permanently or otherwise), for any reason, and without notice. Nothing in this Policy shall be construed to limit Land & Sea International Realty’s rights or remedies available at law or in equity.
